La Comanda, operated by Diego Ismael Cortez Valencia (hereinafter, "La Comanda"), is responsible for the processing of your personal data in accordance with Mexico's Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP).

2. Personal Data Collected

To provide our services, we collect the following categories of personal data:

Restaurant employee data: name, email address, profile image, and assigned roles within the platform.

Restaurant customer data: name, phone number, email address, delivery address, and order history.

Transaction data: order information, payments, tips, and tip distributions among staff.

3. Purposes of Data Processing

Your personal data will be used for the following primary purposes:

Provision of restaurant management services, including point of sale, kitchen display, and digital menu.

Billing and subscription collection through Stripe.

Generation of operational and analytical reports for restaurant administrators.

Service-related communications, such as order notifications and platform updates.

Additionally, and subject to your consent, we use the Meta Pixel to measure the effectiveness of our advertising campaigns and to show relevant ads on Meta platforms (Facebook and Instagram). This purpose is not required to provide the service, and you may grant or withdraw your consent at any time through the cookie banner.

4. Data Transfers to Third Parties

To operate the platform, your data may be shared with the following service providers:

Clerk: authentication and single sign-on (SSO).

Convex: real-time database and server functions.

Stripe: subscription payment processing.

Resend: transactional email delivery.

Meta Platforms, Inc. (Facebook): only if you accept advertising cookies, we share browsing data via the Meta Pixel for measurement and targeted advertising purposes. This data is transferred to the United States.

These transfers are made in accordance with Article 37 of the LFPDPPP and under the privacy and security terms of each provider.

5. ARCO Rights

You have the right to Access, Rectify, Cancel, or Oppose the processing of your personal data (ARCO rights). To exercise any of these rights, send an email to contacto@lacomanda.io with the following information:

Full name and preferred method for receiving notifications.

Clear description of the right you wish to exercise and the personal data involved.

Any documents that may help locate your data.

We will respond to your request within 20 business days of receipt.

6. Use of Cookies

La Comanda uses two types of cookies. Strictly functional cookies are necessary for the proper operation of the platform and do not require your consent:

Session cookies: to securely maintain your active session.

Language preference cookies: to remember your selected language.

Authentication cookies: managed by Clerk for sign-in.

Additionally, we use Meta Pixel advertising and measurement cookies (Meta Platforms, Inc.) to measure our campaigns and show ads on Facebook and Instagram. These cookies are only activated if you grant your consent through the banner shown on your first visit.

You may accept or reject advertising cookies at any time. If you reject them, the Meta Pixel is not loaded and no information is transmitted to Meta. Functional cookies remain active as they are essential for the service.

7. Changes to This Privacy Policy

We reserve the right to modify this Privacy Policy. Any changes will be notified through the platform or by email. We recommend reviewing this document periodically.
